1. WHAT EYESBERG DOES
Eyesberg is a research, knowledge-analysis, synthesis, exploration, and visual-creation platform.
Depending on the features available to you, Eyesberg may allow you to:
- ask questions about source material;
- upload documents, books, text, images, and audio;
- analyze and synthesize ideas;
- create Concept Boards and Idea Lattices;
- compare sources and interpretations;
- perform optional web research;
- generate presentations, visual explanations, audio, or video;
- save, synchronize, publish, or share selected work.
Eyesberg may use artificial intelligence and other automated systems to provide these features.
2. YOUR ACCOUNT
You are responsible for maintaining the security of your Eyesberg account and authorized devices.
You agree to provide accurate account information and to keep it reasonably current.
You are responsible for activity performed through your account unless prohibited by applicable law.
You must promptly notify us at support@eyesberg.ai if you believe your account has been compromised.
3. YOUR SOURCES AND PROJECTS
You retain your rights in the source materials, notes, questions, project information, and other content you provide to Eyesberg.
Private project materials remain private unless you choose to share, publish, or contribute them through a feature that clearly indicates that action.
Uploading a source does not transfer ownership of that source to Eyesberg.
You are responsible for ensuring that you have the legal right to upload, process, copy, analyze, or use material you provide to the Service.
Eyesberg may process your materials as necessary to provide the features you request, subject to the Eyesberg Privacy Policy.
4. USER-CONTROLLED STORAGE AND SYNCHRONIZATION
Eyesberg is designed as a local-first product.
Depending on platform and settings, project data may reside on your device and may optionally synchronize through services such as iCloud or other supported storage providers.
Third-party storage services are governed by their own terms and policies.
You are responsible for maintaining appropriate access to storage providers you choose to use.
Eyesberg cannot guarantee continued availability of a third-party storage provider.
5. ARTIFICIAL INTELLIGENCE AND GENERATED INFORMATION
Eyesberg uses artificial intelligence and automated analysis.
AI-generated information may be incomplete, inaccurate, uncertain, or subject to interpretation.
Eyesberg attempts to preserve source attribution, evidence, uncertainty, and competing interpretations where appropriate, but you should review important information and underlying sources before relying on generated conclusions.
Eyesberg is a research and explanatory tool. It is not a substitute for qualified professional advice where such advice is appropriate.
You remain responsible for decisions you make based on information obtained through Eyesberg.
6. INTELLECTUAL INTERPRETATION AND DISAGREEMENT
Eyesberg may present:
- competing interpretations;
- disputed claims;
- uncertainty;
- user-proposed interpretations;
- source-specific viewpoints;
- interpretations generated by Eyesberg.
The presence of a viewpoint in Eyesberg does not necessarily mean Eyesberg endorses that viewpoint.
Eyesberg may identify uncertainty or evidence that conflicts with an interpretation.
Users remain free to investigate, question, challenge, accept, reject, or preserve competing interpretations subject to available product features.
7. WEB RESEARCH
Web Research is an optional feature where available.
When enabled, Eyesberg may obtain information from external websites and services.
External sources may contain errors, bias, outdated information, or material outside Eyesberg’s control.
Your Sources and Web Sources may be treated separately for attribution and provenance.
Eyesberg does not guarantee the availability or accuracy of third-party web content.
8. SHARED AND PUBLISHED CONTENT
Eyesberg may allow you to deliberately share or publish Concept Boards, videos, presentations, profiles, or other outputs.
You are responsible for content you choose to publish.
Publishing an Eyesberg output does not automatically publish the private source files used to create it.
If you publish content, you grant Eyesberg the limited rights necessary to host, display, transmit, and make that published content available according to the sharing feature you selected.
You may remove or unpublish content where the applicable feature permits.
Removal cannot retract copies another person previously downloaded or independently retained.
9. COMMUNITY OR CONTRIBUTED SOURCES
Eyesberg may allow users to voluntarily contribute eligible material to a shared reference library.
Contribution is separate from ordinary private uploading.
By contributing material to a shared library, you represent that you have the rights necessary to permit the contribution and applicable use.
Eyesberg may review contributed material for:
- rights and licensing;
- quality;
- provenance;
- duplication;
- corruption;
- spam;
- safety;
- integrity.
Eyesberg may reject or remove contributed material.
10. SUBSCRIPTIONS
Eyesberg may offer paid subscription plans such as Eyesberg Pro.
Subscription features, limits, included usage, and pricing are displayed before purchase.
On Apple platforms, subscriptions may be purchased and managed through Apple.
Subscriptions renew according to the terms presented by the applicable store unless canceled before renewal.
Cancellation stops future renewal but ordinarily does not retroactively refund an already completed subscription period except where required by law or provided by the applicable store.
Your access to paid features may continue through the end of the paid subscription period.
Expiration of a paid subscription does not transfer ownership of your project information to Eyesberg.
Locally available user-owned project information should remain accessible subject to technical compatibility and applicable product limitations.
11. USAGE CREDITS
Eyesberg may use credits to measure certain computationally expensive features, including advanced analysis and generation.
The required credit amount should be displayed before a paid operation where reasonably practical.
Eyesberg may offer:
- credits included with a subscription;
- separately purchased credit packs;
- promotional credits.
Credits included as a recurring subscription benefit may reset or refresh according to the subscription terms presented to you.
Separately purchased Apple In-App Purchase credits do not expire solely because time has passed.
Credits:
- are not currency;
- have no cash value except where required by law;
- cannot ordinarily be transferred between unrelated accounts;
- may only be used for eligible Eyesberg services;
- may be subject to fraud and abuse controls.
If an operation fails before billable provider work occurs, Eyesberg should not intentionally charge credits for work that was not performed.
Where third-party generation or processing has already incurred a cost before an operation is interrupted, applicable credits may still be consumed as disclosed by the product.

Do not hard-code dollar prices into these Terms.
13. REFUNDS
Purchases made through Apple are subject to Apple’s payment, refund, and subscription-management systems.
Where Apple controls the transaction, refund requests may need to be submitted to Apple.
Nothing in these Terms limits rights provided by applicable consumer law.
14. EXPORTS
Certain export features may require a paid subscription or other entitlement.
Previously created files that have been successfully exported to storage under your control remain yours.
Eyesberg does not guarantee indefinite regeneration of previously generated assets where underlying providers, models, licenses, or technologies later change.
15. ACCEPTABLE USE
You may not use Eyesberg to:
- violate applicable law;
- intentionally infringe another person’s rights;
- distribute malware;
- gain unauthorized access to systems or accounts;
- interfere with Eyesberg infrastructure;
- evade product security or billing controls;
- fraudulently obtain paid services;
- impersonate another person in a deceptive or unlawful manner;
- use the Service in a way prohibited by applicable platform rules.
Eyesberg may restrict or suspend access where reasonably necessary to protect users, the Service, legal compliance, or security.
16. COPYRIGHT AND THIRD-PARTY MATERIAL
You are responsible for the material you upload or publish.
Eyesberg’s ability to technically process a work does not establish that you have permission to use that work.
Public-domain, licensed, user-owned, and other lawfully usable materials may be treated differently depending on applicable rights.
Third-party materials remain subject to their respective rights and licenses.
17. GENERATED MEDIA AND ASSETS
Eyesberg may create images, audio, video, presentations, diagrams, or other generated outputs using third-party AI or media services.
Rights in generated material may be subject to:
- applicable law;
- provider terms;
- source-material rights;
- platform terms.
You are responsible for determining whether a generated asset is suitable for your intended use.
18. SERVICE CHANGES
Eyesberg is under active development.
Features, providers, limits, pricing, supported file types, models, interfaces, and functionality may change.
We may add, modify, suspend, or discontinue features.
Where a material change affects a paid subscription, user rights will be handled consistently with applicable law and platform requirements.
19. SERVICE AVAILABILITY
We do not guarantee that Eyesberg will operate without interruption or error.
Availability may be affected by:
- Internet connectivity;
- user-selected cloud storage;
- Apple or other platform services;
- AI providers;
- third-party APIs;
- maintenance;
- security incidents;
- events beyond our reasonable control.
Eyesberg is designed to preserve locally available user-owned project information where practical, but no system can guarantee against all data loss.
Users should maintain appropriate backups of important material.
20. SECURITY
You agree not to attempt to bypass Eyesberg security, encryption, device authorization, account controls, billing validation, or synchronization protections.
If you discover a potential security vulnerability, contact:
Do not exploit the vulnerability beyond what is reasonably necessary to identify and report it.
21. TERMINATION
You may stop using Eyesberg at any time.
We may suspend or terminate access where reasonably necessary for:
- serious Terms violations;
- fraud;
- security threats;
- legal requirements;
- abusive use of infrastructure.
Where feasible and legally permitted, we will attempt to provide reasonable notice for account-level enforcement affecting legitimate stored information.
22. DISCLAIMERS
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EYESBERG IS PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DO NOT WARRANT THAT:
- AI-GENERATED INFORMATION WILL ALWAYS BE ACCURATE;
- ALL SOURCES WILL BE COMPLETE OR ERROR-FREE;
- EVERY INTERPRETATION WILL BE CORRECT;
- THE SERVICE WILL ALWAYS BE AVAILABLE;
- THIRD-PARTY PROVIDERS WILL REMAIN AVAILABLE.
Nothing in this section excludes warranties or rights that cannot legally be excluded.
23. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EYESBERG AND ITS OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE.
WHERE LIABILITY CANNOT BE EXCLUDED, IT WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Nothing in these Terms limits liability that applicable law does not permit us to limit.
24. INDEMNIFICATION
To the extent permitted by law, you agree to be responsible for claims arising from your unlawful use of Eyesberg, your violation of these Terms, or content you knowingly provide or publish in violation of another person’s rights.
This provision does not apply where prohibited by applicable consumer law.
25. GOVERNING LAW
These Terms are governed by the laws applicable to the operator in the United States, without overriding mandatory consumer protections that apply where you live.
Do not add a mandatory arbitration clause or class-action waiver without explicit owner approval and appropriate legal review.
26. PRIVACY
Use of Eyesberg is also governed by the Eyesberg Privacy Policy:
27. CHANGES TO THESE TERMS
We may update these Terms as Eyesberg evolves.
Material changes will be reflected by an updated effective date and, where appropriate, additional notice.
Continued use after legally effective changes constitutes acceptance where permitted by applicable law.
